These Terms and Conditions of Business of St. Jodern Kellerei, Unterstalden 2, 3932 Visperterminen/Switzerland (hereinafter sometimes referred to as the "Seller") apply to all sales, deliveries and services of the Seller which the customer purchases from the Seller via remote means of communication. The inclusion of the customer's own terms and conditions is hereby excluded, unless agreed otherwise.
Customers within the meaning of clause 1.1 are both consumers and entrepreneurs, whereby a consumer is any natural person who enters into a legal transaction for a purpose that cannot be attributed to his/her commercial or autonomous professional activity. On the other hand, an entrepreneur is any natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his/her/its autonomous professional or commercial activity. The following Terms and Conditions of Business are written in German and can be downloaded to the customer's memory or printed out; they are also available to the customer for inspection in electronic or printed form upon request. St. Jodern Kellerei Visperterminen provides customers with the opportunity to select and order products on the above-mentioned website. The website contains a separate product description for each product. The customer can select the products he/she wishes to purchase on the website, indicating the desired quantity. These are placed in a virtual shopping cart and at the end of his/her purchase the customer receives a summary of the products with the final total price including value added tax and a separate listing of the shipping costs. St. Jodern Kellerei will process orders within 2 working days. If the ordered products are available, St. Jodern Kellerei will deliver them within 10 working days after receipt of the order.
The list prices at the time of the order are valid as they were shown on the internet pages or the current price list. The prices are quoted from the registered office of St. Jodern Kellerei, Visperterminen, including value added tax, without shipping.
If possible, you will receive your order in a single shipment. We will charge you for postage at the prices stated on our website.
All prices include statutory value added tax. The goods remain the property of St. Jodern Kellerei Visperterminen until full payment has been received.
Payment shall be made by invoice unless otherwise agreed.
Until full payment has been received the goods remain the property of St. Jodern Kellerei. In the event of default of payment, we are entitled to withdraw from the purchase contract. We reserve the right to have the reservation of title registered with the competent authority.
The customer will inform St. Jodern Kellerei, Visperterminen of any defects in the product in writing and will also return the product at the expense of St. Jodern Kellerei.
St. Jodern Kellerei will observe all data protection requirements, in particular the provisions of the German Telemedia Act. The Seller saves the customer's order data and sends these data to the customer by e-mail. For security reasons, the customer's order data are not accessible via the Internet.
If the customer is a trader, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is the Seller's place of business. The right to also bring the matter before the court at another legal place of jurisdiction remains unaffected by this.
The contract language is German. If any provision of these terms and conditions is or becomes void, the remaining provisions shall remain effective. St. Jodern Kellerei and the customer will replace the void provision with a valid provision that comes closest to the economic intention of the contracting parties.
